Argentina: German electronic band’s concert re-instated after appeal
Authorities in Buenos Aires denied German electronic band Kraftwerk a permit for their performance scheduled for 23 November 2016 due to their use of synthesizers in their show; an instrument included in a judicial ban enacted earlier in the year on electronic festivals. A few days later, the concert’s promoters appealed the decision and a judge ruled in their favour, allowing the concert to go on as planned, reported Clarín on 11 November 2016.
The Government Control Agency denied the permits for the concert as they deemed it “an electronic music festival”, a category that fell under a ban imposed in April 2016 following multiple drug-related deaths at such a festival, despite the concert being a stand-alone performance rather than part of a multi-act music festival.
Authorities explained the concert was “promoted as an electronic music festival” and that the band uses synthesizers as their main instruments in their concerts, something which makes it of the same nature as an electronic music festival.
Ban as a consequence of drug abuse
Buenos Aires mayor Horacio Rodriguez Larreta has continued to enforce the blanket ban saying that no permits would be issued for electronic music festivals until a law was passed to prevent drug abuses in such venues.
This decision came after five people died, and another four were taken to hospital in critical condition, due to drug overdoses suffered at the Time Warp electronic music festival in the capital, reported The Guardian on 26 April 2016.
Judge Lisandro Fastman, who ruled in favour of the ban, was the same judge who ruled in favour of letting the Kraftwerk concert go on as scheduled, concluding that authorities had made a very restrictive interpretation of the ban.
